At Basch Keegan & Spada, we've seen firsthand the heartbreaking consequences of nursing home neglect—avoidable deaths, overdoses, and injuries that never should have happened. In many of these cases, the underlying issue is clear: understaffed facilities run by corporations that are more focused on profits than patient care.
Attorney Maureen A. Keegan describes several recent cases as “outrageous,” including a death caused by an untreated infection and an overdose resulting from medication mismanagement. In each instance, proper staffing and oversight could have made all the difference.
This problem goes beyond individual cases. A recent federal prosecution highlights just how deep neglect can run when profit is the priority. Joseph Schwartz, a New York nursing home owner, was sentenced to 36 months in prison for his role in a $38 million tax fraud scheme involving facilities across 11 states. According to prosecutors, Schwartz withheld taxes from employee paychecks and failed to file required financial reports, all while his nursing homes deteriorated under his leadership. His company, Skyline Management Group, ran facilities in multiple states, including New Jersey and New York.
Before placing a loved one in a care facility, families should take the time to research it’s history and reputation. The New York State Department of Health and the Centers for Medicare & Medicaid Services (CMS) offer tools to review complaints, inspections, staffing levels, and quality-of-care ratings.
