• Get medical treatment as soon as possible if you are injured.

• Take photographs of the area where you were injured because a picture can tell a thousand words. Also, take photographs of the injuries to your body if they are external and visible.

• If you were injured in an automobile collision, you need to report the incident to your auto insurance company and the police as soon as possible. You must also submit a filled out a No Fault application to your insurance company within 30 days, even if the accident was totally someone else’s fault. We will fill out your No Fault application and send it to your insurance company for you.

• If you were injured as a result of a fall on someone else’s property, the property owner should be notified about your fall and ask them to notify their insurance company as soon as possible. Their insurance company can disclaim coverage and deny your claim if they do not receive timely notification of an incident.

• Try to find out the names, phone numbers and addresses of any witnesses.

• If you’ve been injured as a result of a defective product, you need to preserve the product. Do not throw it away, do not alter it and do not return it to the manufacturer. Save the original receipt, box, packaging, manuals and other documents if you have them. Take photographs of the product, and then wrap everything up if you are able to do so and keep it in a safe place. We will need all of the parts so that an expert can inspect it.

• Keep a diary after you’ve been injured. A diary can document the details of your injuries and details about the incident shortly after it occurs. Lawsuits can last for several years and you might not be able to recall the details after a long time passes, but your diary will have all of the details as you recorded them shortly after your incident occurred.


• Remember that the statute of limitations is running on your claim. Generally, you have 3 years to begin a lawsuit for most injury claims in New York State. However, there are several exceptions, including:
90 days to file a Notice of Claim against a municipality;
1 year for intentionally inflicted injuries;
2 years for wrongful death;
2 years for Federal Tort claims;
2 ½ years medical, dental and podiatric malpractice claims.
